Atom Lacrosse LLC Training Waiver and Release of Liability

I (hereinafter referred to as the "Participant"), or as the Parent/Legal Guardian of the Participant, a minor (hereinafter referred to as the "Minor Participant"), hereby agree to the terms and conditions of this Waiver and Release of Liability (hereinafter referred to as the "Waiver") in favor of Atom Lacrosse LLC, its agents, representatives, officers, directors, employees, members, and volunteers (collectively referred to as "Atom Lacrosse").

 

In consideration of the opportunity to participate in training sessions and related activities organized and conducted by Atom Lacrosse, the Participant, or the Parent/Legal Guardian of the Minor Participant, hereby agrees to the following terms:

1. Assumption of Risks: The Participant, and/or the Parent/Legal Guardian of the Minor Participant, acknowledges that participating in lacrosse training sessions carries with it certain inherent risks and dangers, including, but not limited to, the risk of physical injury, bodily harm, or even death. The Participant understands and acknowledges that such risks cannot be completely eliminated, and despite Atom Lacrosse's efforts to create a safe environment, accidents or injuries may occur.

2. Release and Waiver: The Participant, and/or the Parent/Legal Guardian of the Minor Participant, on behalf of themselves and their heirs, assigns, executors, and administrators, hereby forever releases and discharges Atom Lacrosse from any and all claims, demands, actions, or causes of action, whether at law or in equity, arising out of or related to any loss, damage, injury, or death that may be sustained by the Participant during or as a result of participating in the training sessions or related activities, whether caused by the negligence of Atom Lacrosse or otherwise.

3. Indemnification: The Participant, and/or the Parent/Legal Guardian of the Minor Participant, agrees to indemnify and hold harmless Atom Lacrosse from any and all liabilities, damages, costs, or expenses (including reasonable attorney fees) incurred by Atom Lacrosse arising out of or related to the Participant's participation in the training sessions or related activities.

4. Medical Treatment: The Participant, or the Parent/Legal Guardian of the Minor Participant, grants permission for Atom Lacrosse to seek and secure medical treatment for the Participant in the event of an emergency or injury. The Participant, and/or the Parent/Legal Guardian of the Minor Participant, shall be solely responsible for any and all medical and related expenses incurred as a result of such medical treatment.

5. Compliance with Rules and Instructions: The Participant, and/or the Parent/Legal Guardian of the Minor Participant, agrees to abide by all the rules and instructions provided by Atom Lacrosse during the training sessions. Failure to comply with such rules and instructions may result in the Participant's removal from the training sessions without any refund or compensation.

6. Severability: If any provision of this Waiver is found to be unenforceable or invalid, such finding shall not affect the enforceability or validity of the remaining provisions, which shall remain in full force and effect.

 

By signing below, the Participant, and/or the Parent/Legal Guardian of the Minor Participant, acknowledges that they have carefully read and understood this Waiver and voluntarily agree to its terms. This waiver is effective immediately upon signature and will remain in effect until it is terminated in writing by the undersigned, which must be provided to Atom Lacrosse at least 30 days prior to the date of termination.
